Tighter Restrictions Set For Wills

Over the last year or so it seems there has been an increase in reports of wills which are not legally binding, and cases where changes in wills are not upheld, as well as there being hundreds of cases where the money or assets left in a will is stolen or under played, meaning the true beneficiaries miss out on money which is legally theirs.

Due to this rise, the government in Scotland is developing new legislation which will give those drawing up a will more protection, and the move in Scotland has left many experts in the rest of the UK suggesting that the legislation there should be reviewed as well. Now the Legal Services Board of England and Wales (LSB) have stated that they are now taking measures to review the current process and guidelines.

These problems appear to have arisen as a direct consequence of will writing firms or professionals being used rather than the traditional solicitors, and as solicitors are governed in a way that will writers are not, more mistakes (whether deliberate or accidental) have been made.

Having your will drawn up by a solicitor means you are engaging the services of someone with a wealth of experience, knowledge and qualifications, as well as being protected by the professional indemnity scheme that the solicitor must enter into.

This is not the case with other types of will writer and whilst many are morally upstanding, there are some who will take advantage of this lack of legislation in order to gain either financially or professionally.

The recent investigation reported cases of will writing fees which were quoted as very cheap, but which then rose to thousands of pounds at the time of death, leaving the deceased’s family to foot a huge, and unexpected bill, and other cases where wills were lost, or funds were stolen.

Scotland’s new regulations are expected to come into force next year, with a full investigation from the LSB expected in England and Wales over the coming months.

A recent poll carried out by the AA has shown that nearly one quarter of the 19,000 people questioned were unaware that it is illegal to use a mobile phone whilst supervising a learner driver. Around one in ten people were also unaware that it was illegal to fall asleep at the wheel. It has been reported that one supervising driver was even jailed after a learner was involved in a crash that resulted in the death of two people. There is always the risk that learner drivers will pick up the bad habits of more experienced drivers without realising.

Shockingly the study also reported that some drivers were breaking the law by drinking, sending sms text messages and failing to wear glasses that they would wear if they were driving themselves.

23% of people asked admitted that they were unaware that using a mobile phone whilst supervising a learner was illegal.

4% of respondents admitted that they had broken at least one of the laws and this grew to 22% in the aged 21- 24 group.

Road safety charity Brake have also expressed their concern and are campaigning for the minimum age for supervising a learner to be upped from 21 to 25.

Recently the law society has announced that it has begun judicial review proceedings against the LSC (Legal Services Commission) over the handling of the tender process for family law contracts. These new regulations will see a huge change in how the family court system is funded and will certainly have an effect on lots of people who have formerly relied on legal aid to fund their legal expenses.

Legal experts and the Legal Services Commission have been left surprised as to the outcome of the new tender process decision-which was announced in August. The LAG has claimed to understand that the law society has met extreme pressure from firms that had successfully won the bid and were campaigning for them not to change the rules again so that they could continue tendering those particular family law cases. The main issue is that the changes may have a bad effect on the people who would previously have relied upon legal aid in order to cover their fees.

Are Sick Employees Entitled To Holiday Pay?

As we are currently in the height of summer, holidays are on everyone’s minds. Increasingly, employers need to take particular care surrounding the sometimes difficult of employee’s entitlement to holidays during illness.

Workers can take paid leave As the statutory holiday continues to accrue during sick leave, this means that a worker will be entitled to take the holiday even if they are on sick leave. So, having given the requisite notice, a worker is entitled to take the leave and be paid the going rate for annual leave rather than sick pay. Even if a worker has used up their entitlement to sick pay, they will be entitled to be paid in respect of their statutory holiday entitlement.

The regulations also say that holiday entitlement cannot be carried over to the next leave year. Taken together this would imply that employers will only be liable to pay for untaken leave in the holiday year in which termination of employment takes effect.

Employers may be able to exploit the situation and overcome a deduction in claim by making payments in lieu of termination of employment.

With the situation remaining unclear at present, this is an issue which is a certainty to be revisited by the courts in the near future.

Convicted Of Drunk Driving – On A Mobility Scooter.

An elderly disabled pensioner has been arrested and convicted of dink driving whilst speeding at 4mph on his mobility scooter. He was arrested after 8 policemen in three cars made the road side stop.

The pensioner, travelling at around 4mph on a pavement close to his Chesterfield home was surrounded by the policemen when he failed to stop. One policeman thought it necessary to mount the pavement with his vehicle to prevent the pensioner from continuing his journey whilst another took his keys.

Eamonn Donohoe uses the mobility scooter as he suffers from blocked arteries in his lower legs. He was pulled over after spending the evening playing dominoes with friends at his local pub. He had consumed six or seven pints.

The pensioner was understandably shaken and somewhat peeved after the incident, he commented “I can’t believe how they treated me – anybody would think that I was a bank robber or a member of Al-Qaeda,” Donohoe told the Daily Mail. The pensioner was kept in police cells for 12 hours, fingerprinted and had his DNA taken.

Mr Donohoe went on to say “I was travelling at three and a half miles per hour. They must have known, like I did, that the rules of the road don’t apply when you’re riding a mobility scooter down the pavement. It didn’t seem to matter one jot. I wasn’t doing anything wrong so I didn’t stop at first because I wanted to get home.”

Mr Donohoe was found to be three times over the legal UK drink driving limit after he failed a roadside breath test. He has been banned from driving; however he has not been banned from driving his mobility scooter as it is not actually classed as car.

Bus Driver Arrested For Drunk Driving

25 passengers were on board a double decker bus, ran by Blustar when it was pulled over on suspicion that the driver was thought to have been drunk driving.

One shocked passenger who does not want to be named commented: “We couldn’t hear the police officers after they had stormed in and were talking to the driver. We all panicked but did not know what to think. We just didn’t have a clue what was happening when we saw the blue flashing lights.”

Police pounced after a member of the public raised concerns. The bus was stopped as it travelled between Southampton and Wincester just as it reached the roundabout at Chilworth. The driver is now out on police bail however he has been suspended by the company.

Public relations manager at Blustar Chris Harris said because of the serious nature of the incident the employee was suspended immediately. The driver was immediately detained by the arresting officers and Bluestar dispatched a substitute driver who arrived to take command of the bus within minutes.

He continued:” The consumption of alcohol while on duty or reporting for duty while under the influence of alcohol is expressly forbidden. It is a strict rule that all Bluestar employees are required to be completely sober at all times when on duty. ”

The safety of passengers aboard Blustar vehicles is paramount to their operations, so it is important to reassure passengers through swift response to issues such as this one that they are willing to do what is necessary to ensure safety. Russell Jones and Walker, the personal injury specialists, has launched 2 Way Street, a campaign that aims to bring HGV drivers and cyclists together.

The campaign, fronted by Gail Porter, calls for HGV drivers to have cycle awareness training, for cyclists to be encouraged to take cycle training to cope with busy urban roads, and for more investment in the design of cycle-friendly roads. The campaign is supported by CTC, the UK’s national cyclists’ organisation.

On average, every year approximately eight cyclists a year are killed by lorries in London and about 28 are killed by lorries across the UK, with 70% of these in urban areas.

Mother Warns Of NHS Failings After Grandfather Stabbed To Death

On the 24th of July 2009, 30-year-old William Barnard grabbed a kitchen knife, left his flat and walked a short distance to the home of his grandparents, John and Mabel McGrath. Mr McGrath opened the door to his grandson, who proceeded to plunge the knife into his body. William, a paranoid schizophrenic, killed his grandfather after stabbing the 81-year-old no less than 56 times; Mrs McGrath was also injured during the attack. In June, William was committed to Rampton high security hospital.

Upon sentencing William, Judge Michael Stokes QC said that it was a “matter of grave concern” that the NHS had missed numerous chances to send the paranoid schizophrenic to hospital prior to the death of his grandfather.

Now, solicitors acting on behalf of William’s mother, Kath Barnard, have called for an independent inquiry into why the Nottinghamshire Healthcare NHS trust failed to section William despite repeated requests by his family in the build-up to Mr McGrath’s death.

A specialist NHS AO team, which was tasked with ensuring that psychiatric patients remain out of hospital, was expected to visit William every 2 weeks. However, it has emerged that the AO gave William his fortnightly injection of Depixol, an anti-psychosis drug, in December 2008 and saw him just 4 times in the following 6 month period.

An AO medical team had even visited William on the morning of Mr McGrath’s death but failed to act despite observing blood stains on the door handle. William’s family had warned NHS experts of his deteriorating condition some thirty times prior to Mr McGrath’s death.
