Injury Settle

If you have any questions regarding injury settlement this is a great article and has some real good information that answers these questions.  I hope you enjoy this as I did.

The amount of personal injury settlement depends on many factors, and there is no fixed value for any compensation package. The amount settled on depends on factors like age of the claimant, severity of injury, net financial loss, medical expenses incurred, medical prognosis, extent of liability, etc.

There is no minimum or maximum compensation amount limit set by law, since amounts vary greatly from case to case. The following examples give you an idea of the compensation due in cases of personal injury.

A construction company, for example, paid a compensation of $2,000,000, when held liable for the death of a young man caused by unsafe construction. A retail store paid out $1,000,000, when a claimant suffered serious neck injuries when a display fell on her. A nursing home paid $1,000,000 for medical negligence when an Alzheimer’s patient was injured due to the absence of a nurse on duty. Injury due to an automobile accident aggravated a victim’s previous neck injury, and the he was paid $5,000,000 in compensation.

The highest compensation values are given to those plaintiffs who are young and healthy. This is because the jury takes into consideration the financial loss and mental anguish caused to those victims who would, in all probability, have been highly productive had they not been injured or handicapped.

Severity of injury is another factor. A first degree burn which heals quickly and leaves no scars is compensated by a minor amount. But a third degree burn, if spread over 50% of the body, for example, can claim up to $8,00,000, as in a case where a coal mining company was sued when a minor needed an amputation due to the company’s negligence.

Lost wages are also considered when settling such cases. The court takes into account the occupation of the claimant, education levels and future prospects when awarding a compensation amount.

It is also important that the plaintiff come across as someone sincere who genuinely needs help, and not an opportunist just waiting to sue due to financial motives. The personal injury settlement amounts are meant to help those in distress get on with life, and not simply a financial “dole”.

No. You only report EARNED income. This is not earned income.

Before you hire a personal injury attorney/lawyer – maybe this article will help.  Most of the time personal injury lawyers will meet with you at no cost to determine your case.

To Hire or not to Hire a Personal Injury Settlement Lawyer

Personal injury claims are filed and heard in courts almost every day. Not a day passes without anyone seeing, hearing or reading of personal injury incidents.

If you happen to be a victim of a personal injury or accident, certainly, you have the right to receive compensation for your damages. But in asking for compensation, you must learn to navigate the legal system and understand its intricacies. In doing so, you will avoid its dangers.

Going through the usual legal processes can be very demanding, time consuming and attention grabbing. Consequently, most victims opt to enter into a settlement to avoid the tedious and often confusing court proceedings.

The problem with settlement especially if one settles alone is that a victim gets less than what he or she deserve for his or her injury.

You may have sustained an injury; the next question now is whether to hire or not to hire a personal injury settlement lawyer.

Advantages of Hiring a Lawyer

Admittedly, the presence of a lawyer is not always necessary in settlement claims. Anyone may or may not choose not to be represented by a lawyer. In fact, some may say that hiring a lawyer will just be a waste of money because personal injury cases are easy and clear-cut.

Yes, in some cases, although not advisable, it may be applied but not at all times.

Hiring a personal injury lawyer is and will always be the best idea. He/She can offer the following services for you:

• gather evidence

The compensation due you would depend on the extent of the injuries suffered, which may be proved by evidence such as medical records and police reports. Knowing how much your injury‘s worth is essential to negotiating.

He/She will also do the necessary legwork in gathering evidence. Your participation would only be limited to signing consent or releases to obtain essential information concerning the accident.

• expertise and experienced on personal injury law

Having been exposed to numerous cases pertaining to personal injury, most likely he or she has attained multitude of skills and a depth of knowledge on the subject.

• negotiate with insurance companies

Dealing with insurance adjuster can be very tricky. If you do not play their game, chances are you will end up losing a rightful claim. In fact, adjusters will try to convince you to accept the lowest settlement possible.

Here is the point: by knowing your rights and understanding how the legal system works, you will have a higher chance of getting what you lawfully deserve for your injuries. These may be best attained if you have someone to accompany and represent you in the settlement.

Remember, the offending party will do anything to defeat your claim. In fact, he or she will put the blame on you to mitigate his or her liability or even evade responsibility.

Moreover, some laws relating to personal injury can be very complicated and confusing for ordinary people to understand.

There is no doubt that hiring a lawyer is far more advantageous than not having someone represent you.
